SCOTUScare is law, what you can do about it

Obamacare 2The Supreme Court has upheld Obamacare with its decision in the King v Burwell case. This is a sad day for America. In all the frustration, there is a bit of light. There is something we can do in reaction to this decision. We the people have the power.

Just to get you up to date with what happened…

From Reason, “The High Court has ruled 6-3 in favor of the administration to uphold the subsidies in Obamacare’s federal exchanges. The case challenged the administration’s decision, through the Internal Revenue Service, to allow subsidies in the 36 exchanges run by the federal government under the law.”

The law was written to give subsidies through state exchanges for healthcare. Several states including Ohio, did not set up a state exchange. The IRS decided to administer the subsidies to pay for the health care of recipients through federal exchanges.

The question was taken to the Supreme Court, the law says the subsidies should go through the state exchanges, they are not, they are going through the federal exchange. Is this legal? Today, the court ruled that it is. Even though it is clearly written in the law that the subsidies are to come from the state exchanges, the law was essentially rewritten by the court.

From Politico, Justice Scalia says the Court, “Rewrites the law to make tax credits available everywhere,” he continued. “We should start calling this law SCOTUScare.”

Justice Scalia said in his dissenting opinion, ““Words no longer have meaning if an Exchange that is not established by a State is ‘established by the State”.

From the Michael Cannon at the Cato Institute, “Today the Supreme Court allowed itself to be intimidated. Afraid that ObamaCare as written would throw the sickest patients out of their health plans a second time, the Court rewrote ObamaCare to save it—again. In doing so, the Court has sent a dangerous message to future administrations: If you are going to violate the law, make sure you go big.”

Presidential candidate, Senator Rand Paul says, “This decision turns both the rule of law and common sense on its head. Obamacare raises taxes, harms patients and doctors, and is the wrong fix for America’s health care system.”

From Congressman Jim Jordan, “Healthcare policy should be about empowering and helping people, not government. Obamacare is raising the cost of healthcare for Americans everywhere. It’s time to repeal this bad law. Congress must get rid of this law once and for all, and replace it with patient-centered fixes that promote personal freedom and spur job creation, instead of stifling both.”

What can we do now…. First, we must not accept a Republican plan to tinker and make Obamacare more efficient. We must expect a full repeal. We must not accept a plan to make socialism work better. We must have a plan to repeal socialism.
